2. What do we do with your personal data? 

a) When you visit our website or contact us

b) When you subscribe to our newsletter

You can register for our newsletter on our website by giving your consent. For this purpose, we collect the personal data that you enter in the registration form. We also use our service provider ActiveCampaign to evaluate the reach of our newsletter (see the “ActiveCampaign”). This enables us to analyze your newsletter behavior.

        (2) Recipient categories

We use ActiveCampaign as part of our newsletter service. This service provider partially processes personal data outside of the EU/EEA (see below the section “Data transfer to third countries”). We transmit personal data to this service provider for this purpose. This service provider is obliged by us to exercise the same care in the processing of personal data as we do.

c) When you follow us on social media platforms

You have the option of following us on social media platforms (e.g. LinkedIn, XING, Twitter, Facebook and Instagram). For this purpose, we handle the personal data that you make available to us or which are made available to us by the respective platform operator about you, insofar as they are made available to us. You can control the privacy settings yourself within the framework of the social media platforms.

We use service providers to provide our social media offerings (e.g. LinkedIn, XING, Twitter, Facebook and Instagram). The data you transmit to us as part of our social media offerings is also automatically transmitted to the respective social media platform operator, including to countries outside the EU/EEA (see the “Data transmission to third countries” section below).

d) When we anonymize your personal information

We anonymize your personal data in order to evaluate it for statistical purposes.

The processing of your personal data in the context of such an anonymization takes place on the basis of our overriding legitimate interest.

        (2) Balancing of interests

As part of the necessary balancing of interests, we weighed your interest in confidentiality against our interest in a corresponding anonymization. Your interest in confidentiality takes a back seat. We could otherwise not achieve such anonymization. The GDPR and the BDSG do not apply to anonymous data.

        (3) Recipient categories

We use service providers for the anonymization process. We transmit personal data to these service providers for this purpose. These service providers are contractually obliged by us to exercise the same care when handling personal data as we do.

e) If we sell our business and/or a service

We reserve the right to sell our company and/or a service in whole or in part. We can transfer your personal data to a third party in the future, in compliance with the respective data protection requirements. We will inform you of this with a notice period of at least 30 days with reference to the consequences for further use of our services.

f) If you allow the use of cookies and analysis tools in your browser

We use cookies and analysis tools to provide our website. Some providers that we use also process your personal data outside of the EU/EEA (see the “Data transfer to third countries” section below). Cookies are data sets that are stored by a web server on the end device (e.g. computer, smartphone or tablet) of the user. When you visit our website again with the same end device, these are sent back either to our website (“First Party Cookies”) or to another website to which the cookie belongs (“Third Party Cookies”).

The legal basis for the use of technically necessary cookies/identifiers is our legitimate interest. The storage of information in the terminal device or the access to information already stored in your terminal device is absolutely necessary so that we can provide you as the user with the telemedia service that you have expressly requested (§ 25 Para. 2 No. 2 TTDSG; Art. 6 Para. 1 lit. f) GDPR).

Otherwise, the legal basis is generally your consent if no specific legal basis is mentioned below (Section 25 (1) TTDSG; Article 6 (1) (a) GDPR). You can revoke your consent at any time with effect for the future, e.g. by deleting the cookies set in the browser settings of your end device. We use Usercentrics as a processor. We transmit personal data to Usercentrics for this purpose. Usercentrics is contractually obliged by us to exercise the same care when handling personal data as we do.

h) Use of Google Analytics

We use Google Analytics on our website, an advertising analysis service provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google").

Google Analytics uses cookies, which are stored on your end device and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, by activating IP anonymization, your IP address will be shortened beforehand by Google within the EU/EEA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On our behalf, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide us with other services related to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

i) Use of Google Tag Manager

We use the Google Tag Manager (https://www.google.com/intl/de/tagmanager/) from Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google").

With the Google Tag Manager, tags from Google and third-party services can be managed and bundled and embedded on an online presence. Tags are small pieces of code on an online presence that are used, among other things, to measure visitor numbers and behavior, understand the impact of online advertising and social channels, use remarketing and targeting, and test and optimize online presences. When a user visits the online presence, the current tag configuration is sent to the user's browser. It contains instructions on which tags to fire. j) Twitter conversion tracking

We use the remarketing function of Twitter Inc., 1355 Market St, San Francisco, California 94103, USA ("Twitter"). This allows us to address you with interest-based advertising on the Twitter platform. For this purpose, Twitter uses "tags" about the users of our website as well as data about the use in pseudonymous, non-personal form. Twitter receives information from your browser that our website has been accessed from your device. The information generated by the tags about your use of our services is transmitted to a Twitter server in the USA and stored there.

The use of this service is based on your consent in accordance with Article 6 Paragraph 1 Letter a GDPR and Section 25 Paragraph 1 TTDSG. The consent can be revoked at any time.

k) Facebook pixels

We use the marketing tool Pixel from Facebook. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the data collected is also transferred to the USA and other third countries.

With the service, the behavior of website visitors can be tracked and evaluated after they have been forwarded to the provider's website via Facebook advertising.

The data collected is anonymous to us, we cannot draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes. l) LinkedIn Insight Tag

We use LinkedIn's Insight tag. The provider of this service is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

With the help of the LinkedIn Insight Tag we receive information about the users of our website. If a website visitor is registered with LinkedIn, we can, among other things, analyze the professional key data of our website visitor and thus better align our website to the respective target groups. We can also use LinkedIn Insight Tags to measure whether visitors to our website make a purchase or take another action (conversion measurement). LinkedIn Insight Tag also offers a retargeting function that we can use to show visitors to our website targeted advertising outside of the website.

LinkedIn itself also collects so-called log files (URL, referrer URL, IP address, device and browser properties and time of access). The IP addresses are shortened or pseudonymised. LinkedIn will store the personal data collected from website visitors on its servers in the USA and use it for its own advertising purposes. m) Google Ads

We use "Google Ads", an online advertising program from Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google. Furthermore, targeted advertisements can be displayed based on the user data available from Google. We can evaluate this data, for example by analyzing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.

The use of this service is based on your consent in accordance with Article 6 Paragraph 1 Letter a GDPR and Section 25 Paragraph 1 TTDSG. The consent can be revoked at any time.

n) Bing ads

We use the remarketing function "Bing Ads" from Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. Microsoft Bing Ads stores a cookie on your computer if you have accessed our website via a Microsoft Bing ad. This makes it possible to track advertisements played out. We only learn the total number of users who clicked on a Bing ad and were then forwarded to the conversion page. No personal information on the identity of the user is communicated.

o) Active Campaign

This website uses Active Campaign to send newsletters. The provider is Active Campaign LLC, 1 North Dearborn St., 5th Floor, Chicago, IL 60602. Active Campaign is a service that can be used to organize and analyze the sending of the newsletter. The data you enter for the purpose of subscribing to the newsletter (e.g. e-mail address) will be stored on the Active Campaign servers in the USA.

p) Make an appointment on the website with Calendly

To arrange appointments via our website, we use the "Calendly" tool from the provider Calendly, LLC, 3423 Piedmont Road NE, Atlanta, GA 30305-1754, United States.

Free appointments are displayed in Calendly. After choosing an appointment, you will be asked to provide your contact details (name, e-mail address and telephone number). The e-mail address is required to confirm the appointment.

Data processing for the purpose of contacting us takes place in accordance with Article 6 Paragraph 1 Clause 1 Letter a GDPR on the basis of your voluntarily given consent. The personal data collected by us for the appointment will be automatically deleted after the appointment and the completion of the request you have made.

If your request is aimed at the conclusion of a contract, Art. 6 (1) sentence 1 lit. b) GDPR serves as the legal basis. In this case, we store your data for the duration of the statutory retention periods.

3. How long do we store your personal data?

We delete your personal data if the purpose of storage no longer applies and storage is not required by law.

4. What rights do you have as a data subject?

To exercise your rights and to revoke your consent, please use the above contact details.

a)     You have the right to request information about all of your personal data that we process at any time.

b)     If your personal data is incorrect or incomplete, you have the right to correction and supplementation.

c)     You can request the deletion of your personal data at any time, unless we are legally obliged or entitled to further process your data.

d)     If the legal requirements are met, you can request that the processing of your personal data be restricted.

e)  You have the right to object to the processing if the data processing is for the purpose of direct advertising or profiling. If the processing is based on a balance of interests, you can object to the processing by stating reasons that arise from your particular situation.

f)     If the data is processed on the basis of your consent or as part of a contract, you have the right to transfer the data you have provided, provided that this does not affect the rights and freedoms of other people.

g)     If we process your data on the basis of a declaration of consent, you have the right to revoke this consent with effect for the future at any time. The processing carried out before a revocation remains unaffected by the revocation.

h)     You also have the right to lodge a complaint with a data protection supervisory authority at any time if you believe that data processing has violated applicable law.

We inform all recipients to whom we have disclosed personal data of any correction or deletion of your personal data or a restriction of the corresponding processing, unless this proves to be impossible or is associated with a disproportionate effort. 5. In what context do we create automatic profiles? 

No automatic profiles are created.

6. Data transfer to the USA

In some cases, personal data is transferred to recipients in third countries (see the respective corresponding note within the scope of our data protection information). Third countries are countries outside the EU / EEA. These third countries also include the USA.

In the USA, there is no comparable level of data protection as in Europe. In particular, it is possible that government agencies access personal data without us or you knowing about it. Legal prosecution may not be promising.

In principle, the legal basis for such data processing here can be your consent (Art. 49 (1) p. 1 lit. a) DSGVO) or a respective contract performance (Art. 49 (1) p. 1 lit. b) DSGVO). We also conclude EU standard contractual clauses with our service providers where possible and implement supplementary measures. We take appropriate technical and organizational security measures to protect the personal data we process against accidental or intentional manipulation, loss, destruction or against unauthorized access.
